BROADBAND BREAKFAST INSIGHT: California is merely the largest of the large number of states that have attempted to take a “federalist” approach to the “interstate commerce” of network neutrality. This sets up the first of many political flashpoints over the issue.

That didn’t take long.

Less than two hours after the announcement that governor Jerry Brown signed [senate bill 822](http://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill%5Fid=201720180SB822&ref=broadbandbreakfast.com) and made network neutrality the law of the land in California, the federal government struck back. The federal justice department filed a lawsuit challenging it with the federal district court – the eastern district – that covers Sacramento.

They had their finger on the button. Two filings and [the obligatory press release](https://www.justice.gov/opa/pr/justice-department-files-net-neutrality-lawsuit-against-state-california-0?ref=broadbandbreakfast.com) were ready to go. [One is a complaint](https://tellusventure.com/downloads/policy/net%5Fneutrality/doj%5Fcomplaint%5Fcalifornia%5Fnet%5Fneutrality%5F30sep2018.pdf?ref=broadbandbreakfast.com), um, complaining that California “seeks to second-guess the Federal Government’s regulatory approach”.
